Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Qubit Forge Pty Ltd (“Qubit Forge,” “we,” “us,” or “our”) governing your access to and use of the Qubit Forge platform, including any content, functionality, and services offered.
By creating an account or using Qubit Forge, you agree to be bound by these Terms. If you do not agree, you may not access or use the platform.
Eligibility
To use Qubit Forge, you must:
- Be at least 16 years of age
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the platform under applicable laws
If you are using Qubit Forge on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Account Registration
Creating an Account
To access most features, you must create an account by providing:
- A valid email address
- A unique username
- A secure password
You agree to provide accurate, current, and complete information and to update it as necessary.
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
We are not liable for any loss arising from unauthorized use of your account.
Account Termination
You may delete your account at any time through account settings or by contacting support.
We may suspend or terminate your account if you:
- Violate these Terms or our Acceptable Use Policy
- Engage in fraudulent or illegal activity
- Fail to pay applicable fees
- Remain inactive for an extended period (with notice)
Platform Services
Description of Services
Qubit Forge provides:
- Quantum programming challenges with automated evaluation
- Quantum circuit execution on simulators and hardware
- Performance tracking and profile generation
- Community features including forums and leaderboards
- Institutional tools for cohort management and analytics
Service Availability
We strive to maintain platform availability but do not guarantee uninterrupted access. We may:
- Perform scheduled maintenance (with reasonable notice)
- Modify or discontinue features
- Experience downtime due to circumstances beyond our control
Execution Resources
Execution of quantum circuits is subject to:
- Resource limits based on your subscription tier
- Queue times for hardware execution
- Technical limitations of simulators and hardware
We do not guarantee specific execution times or outcomes.
Subscriptions and Payments
Subscription Tiers
We offer multiple subscription tiers with varying features and limits. Current offerings are described on our Pricing page.
Billing
For paid subscriptions:
- Fees are charged in advance on a monthly or annual basis
- Payment is processed through our payment provider (Stripe)
- You authorize us to charge your payment method for recurring fees
- Prices are in Australian Dollars (AUD) unless otherwise specified
Price Changes
We may change subscription prices with at least 30 days' notice. Price changes apply to the next billing cycle after the notice period.
Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain access until the end of your current billing period
- No refunds are provided for partial periods
- Your account reverts to Free tier features
Refunds
- We offer a 14-day trial for Pro subscriptions
- Refund requests within 30 days of initial subscription are considered on a case-by-case basis
- Contact support@qubitforge.com.au for refund requests
User Content and Submissions
Your Content
You retain ownership of content you create and submit, including:
- Quantum circuit code
- Forum posts and comments
- Profile information
License to Qubit Forge
By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:
- Store and process your submissions for evaluation
- Display your public profile and leaderboard rankings
- Use anonymized submission data for platform improvement
- Include anonymized data in aggregated research and benchmarks
This license continues after account termination for content that has been anonymized or aggregated.
Content Restrictions
You agree not to submit content that:
- Infringes intellectual property rights
- Contains malicious code or exploits
- Violates any applicable law
- Violates our Acceptable Use Policy
We may remove content that violates these Terms without notice.
Intellectual Property
Qubit Forge Property
The platform, including its design, code, challenges, documentation, and branding, is owned by Qubit Forge and protected by intellectual property laws.
You may not:
- Copy, modify, or distribute platform code or content
- Reverse engineer or decompile the platform
- Use our trademarks without permission
- Scrape or automatically collect data from the platform
Challenge Content
Challenges are proprietary to Qubit Forge. You may:
- Solve challenges for personal learning
- Discuss challenge concepts in community spaces
- Reference your completion in your profile
You may not:
- Reproduce or distribute challenge specifications
- Share complete solutions that would undermine others' learning
- Use challenges for commercial purposes without permission
Open Source
Certain components or tools may be released under open-source licenses. Those components are governed by their respective licenses.
Institutional Accounts
Institutional Administrators
Organizations with institutional accounts may designate administrators who can:
- Create and manage cohorts
- Add users to cohorts
- Access aggregated performance data
- Assign challenges and set deadlines
User Consent
Users must consent to join institutional cohorts. By joining, you agree that:
- Your performance data may be shared with cohort administrators
- Your institution may use this data for assessment purposes
- You remain bound by these Terms
Institutional Responsibilities
Institutions agree to:
- Use data only for legitimate educational or organizational purposes
- Protect user privacy in accordance with applicable laws
- Ensure authorized administrators follow these Terms
Community Guidelines
Participation in community features is subject to our Acceptable Use Policy and Code of Conduct.
We reserve the right to moderate content and remove users who violate community standards.
Disclaimers
Platform Provided “As Is”
QUBIT FORGE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee of Results
We do not guarantee that:
- The platform will meet your specific requirements
- Challenges will prepare you for any particular outcome
- Performance profiles will lead to employment or academic success
- Execution results will be accurate or reproducible
Third-Party Services
The platform integrates with third-party services (payment processors, hardware providers, etc.). We are not responsible for the availability, accuracy, or policies of third-party services.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUBIT FORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Qubit Forge, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any third-party rights
- Your content or submissions
Dispute Resolution
Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
Informal Resolution
Before initiating formal proceedings, you agree to contact us at legal@qubitforge.com.au to attempt to resolve any dispute informally.
Jurisdiction
Any disputes not resolved informally shall be brought exclusively in the courts of New South Wales, Australia. You consent to the personal jurisdiction of such courts.
Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action or class-wide arbitration.
Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by:
- Posting updated Terms on the platform
- Sending email notification to registered users
- Displaying a notice upon login
Your continued use of Qubit Forge after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the platform.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Qubit Forge regarding the platform.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
Force Majeure
We are not liable for any failure to perform due to circumstances beyond our reasonable control.
